OSHA Publishes Guidance on Transgender Restroom Access; DOL Letter Addresses LGBT Employment Discrimination

The Occupational Safety and Health Administration (OSHA) has published new guidance for employers on best practices regarding restroom access for transgender workers. Developed at the request of the National Center for Transgender Equality, an OSHA Alliance partner that works with the agency to develop materials to protect the safety and health of transgender workers, A Guide to Restroom Access for Transgender Workers emphasizes that all employees should be permitted to use facilities that correspond with their gender identity (e.g., a person who identifies as a man should be permitted to use men's restrooms, a person who identifies as a woman should be permitted to use women's restrooms) and that no employee should be forced to use segregated facilities based on their gender identity or transgender status.
