DOJ Final Rule Would Nearly Double Minimum Per-Claim Penalty Under the False Claims Act

The U.S. Department of Justice (DOJ) on June 30, 2016, announced a final rule that would nearly double the minimum per-claim penalty under the False Claims Act (FCA) from $5,500 to $10,781. DOJ would also increase the maximum per-claim penalty from $11,000 to $21,563. These amounts will apply only to civil penalties assessed after August 1, 2016, regarding claims from after November 2, 2015. Written and electronic comments must be submitted on or before August 29, 2016.
