CMS Considers Process to Address Medicare Secondary Payer Provisions for “Future Medicals”

The Centers for Medicare and Medicaid Services (CMS) is seeking comments on its plans to draft a rule to standardize a process for Medicare beneficiaries and their representatives to meet their obligations for Medicare secondary payer provisions regarding settlements, judgments, and other types of liability payments that involve future medical care. The advance notice of proposed rulemaking, published in the June 15, 2012, Federal Register, lists seven options that CMS is considering for beneficiaries and their representatives to address what is commonly referred to as “future medicals.”
