A member recently asked for resources related to developing policies on patients recording staff with their cell phones during procedures. In our response we discuss advantages and disadvantages of patient recordings, state eavesdropping or wiretapping laws, and resources with further considerations.
Healthcare organizations, providers, and staff report varying concerns and levels of comfort with the idea of patients recording clinical encounters. For example, while some raise concerns that recordings by patients harm patient-provider trust and could be detrimental in the event of a lawsuit, others believe that recordings may help patients remember important information and may help defend appropriate care during a lawsuit.
