CMS Adjusts Civil Monetary Penalties for Inflation

​The maximum civil monetary penalty (CMP) for several infractions will more than double after adjustments for inflation provided by an interim final rule published by the Department of Health and Human Services (HHS) and the Centers for Medicare and Medicaid Services (CMS) in the Federal Register on September 6, 2016. The maximum penalty for certification of a false statement in assessment of functional capacity, for example, will increase from $1,000 to $2,063. This is the first time the figure has been adjusted since 1987. A full list of the CMP adjustments is available from CMS.
