Taking photos and video in aging services settings—by the organization, staff, residents, family members, or others—is fraught with legal and regulatory risks. Failure to develop and ensure adherence to appropriate policies could lead to negative media attention, state or federal investigations, civil or even criminal penalties, fines, or private lawsuits. However, photography may be beneficial, even necessary, to support quality care or resident safety. Well-developed policies, as well as training and other communication about rules and procedures, can help aging services organizations reap the benefits of photography while managing the risks.
