Ask CCRM: Release of Clinical Records: Risk Management Issues

A Continuing Care Risk Management (CCRM) member recently asked about risk management issues regarding the release of clinical records. Requests by residents or their representatives for the residents’ records from a continuing care organization present a situation in which extreme care must be taken to respond appropriately and provide an opportunity for the risk manager to be made aware of a potential claim or lawsuit. The risk manager or his or her designee should be notified of all requests for resident records.
