Memory Care Resident Dies after Other Resident Pushes Him to Ground; $310K Verdict

​A resident of a memory care facility died after another resident pushed him to the ground. In a lawsuit a family member brought against the facility in the U.S. District Court for the District of Montana, the jury awarded the plaintiff and the resident's estate $310,000, according to an article in the May 2022 Medical Malpractice Verdicts, Settlements & Experts.

The resident was 73 years old and had dementia. Four days after he was admitted to the facility, he approached another resident while holding kitchen utensils. The other resident became scared and aggressive. When the resident holding the utensils turned around to walk away, the other resident pushed him to the ground.
